1. What is a power of attorney and what is the purpose of having one?
Answer: A power of attorney is a legal document created by a person called the Principal designating a spouse or family member or other trusted person commonly known as the Agent to handle financial and administrative affairs upon the disability or inability of the Principal to act.
2. What is a Durable of Power and how does it differ from a General Power of Attorney?
Answer: A Durable Power of Attorney survives the disability or incapacity of the Principal, whereas a Durable Power of Attorney becomes invalid upon the Principal’s incapacity.
NOTE: Either Power of Attorney should become effective immediately and not upon disability and incapacity as part of Strategic Estate Planning in order to avoid delay when required to be used at banks and other financial and administrative institutions. 3. What are the advantages of having a Financial/Durable Power of Attorney?
Answer: A Durable Power of Attorney avoids the necessity for a Guardianship or Conservatorship legal action during times of your disability. A Power of Attorney allows your appointed Agent to manage and protect your financial affairs without the need for court orders to handle and preserve your finances and administrative matters.
4. Can I revoke or change a Power of Attorney once established?
Answer: Yes, You can revoke or change your Power of Attorney at any time so long as you are mentally competent.
NOTE: You should notify your Agent, financial institutions and interested parties by written revocation.
5. What types of decisions can your Agent for your Durable Power of Attorney make on your behalf and what restrictions exist to protect your interest?
Answer: An Agent can make all decisions regarding your financial and administrative affairs including paying bills and maintaining accounts in good order.
6. What is the difference between a Health Care Power of Attorney and a Financial Power of Attorney?
Answer: Each document covers different issues entirely as the documents named indicate. The Health Care Power of Attorney covers all medical issues and decisions during times of your inability to act. This Health Care Power of Attorney should also include the HIPAA (Health Information Release) consent. The General Power of Attorney gives control to your Agent to handle your financial and administrative needs during times of incapacity or inability to act.
NOTE: Both forms of Powers of Attorneys should be written to allow for immediate authority to act in order to avoid unnecessary delays at the time of need for decisions and actions to be immediate in times of disability.
